1. Agreement to Terms

These Terms and Conditions constitute a legally binding agreement between you and Fiscal Pathways regarding your use of our educational programs and services. By registering for programs, attending sessions, or using our website, you acknowledge that you have read, understood, and agree to be bound by these terms.

If you do not agree with these terms, you should not register for or participate in our programs. We reserve the right to refuse service to anyone for any reason at any time.

2. Definitions

For purposes of these Terms and Conditions:

  • "Services" refers to the educational programs, workshops, courses, and related materials provided by Fiscal Pathways.
  • "Participant" or "You" refers to individuals who register for, attend, or use our services.
  • "Content" refers to all materials, information, and intellectual property provided through our services.
  • "We", "Us", or "Company" refers to Fiscal Pathways and its representatives.

3. Use of Services

3.1 Eligibility

Our programs are designed for adults aged 18 and over. By registering, you represent that you meet this age requirement and have the legal capacity to enter into this agreement. If you are registering on behalf of an organization, you represent that you have authority to bind that organization to these terms.

3.2 Account Responsibilities

You are responsible for maintaining the accuracy of information provided during registration. You must notify us promptly of any changes to your contact information to ensure you receive important program communications.

3.3 Accurate Information

All information you provide must be current, complete, and accurate. Providing false information may result in termination of your participation without refund.

4. Prohibited Activities

You agree not to:

  • Use our services for any unlawful purpose or in violation of applicable laws
  • Reproduce, distribute, or create derivative works from program materials without written permission
  • Record sessions (audio or video) without explicit written consent
  • Share login credentials or program access with unauthorized individuals
  • Disrupt or interfere with the learning environment of other participants
  • Harass, intimidate, or engage in inappropriate conduct toward instructors or other participants
  • Attempt to access restricted areas of our systems or networks
  • Misrepresent your identity or affiliation
  • Use automated systems to access or interact with our services
  • Resell or commercialize program content or materials

5. Intellectual Property Rights

5.1 Our Property

All program content, materials, curriculum, presentations, handouts, and related intellectual property remain the exclusive property of Fiscal Pathways. This includes but is not limited to text, graphics, designs, methods, and educational frameworks.

5.2 Limited License

Upon enrollment, we grant you a limited, non-exclusive, non-transferable license to access and use program materials solely for your personal educational purposes. This license does not permit commercial use, reproduction, or distribution.

5.3 Restrictions

You may not modify, translate, reverse engineer, decompile, or create derivative works based on program materials. You may not remove copyright notices or proprietary markings from any materials.

6. Payment and Fees

6.1 Program Fees

All fees are stated in Canadian Dollars (CAD) and are due according to the payment schedule provided during registration. Enrollment is not confirmed until payment is received or payment arrangements are approved.

6.2 Payment Methods

We accept payment by credit card, debit card, bank transfer, and other methods as specified during registration. Payment plans may be available for certain programs as indicated.

6.3 Price Changes

We reserve the right to modify program fees for future offerings. Once you have registered and paid, your fee is locked and will not be subject to increases.

6.4 Taxes

Applicable taxes (including GST where required) will be added to program fees as specified during registration. You are responsible for any taxes associated with your participation.

7. Cancellation and Refund Policy

7.1 Participant Cancellations

Cancellations must be submitted in writing to [email protected]. Refund eligibility depends on timing:

  • More than 14 days before program start: Full refund minus $50 administrative fee
  • 7-14 days before program start: 50% refund
  • Less than 7 days before program start: No refund

7.2 Our Cancellations

We reserve the right to cancel programs due to insufficient enrollment or unforeseen circumstances. In such cases, you will receive a full refund or the option to transfer to a future session.

7.3 Processing Time

Approved refunds are processed within 14 business days and will be issued to the original payment method.

8. Disclaimers and Limitations

8.1 Educational Purpose

Our programs provide educational content and are not professional financial advice. We do not recommend specific financial actions, products, or strategies for your individual circumstances. Participants should consult qualified financial professionals before making significant financial decisions.

8.2 No Guarantees

While we strive to provide accurate and current information, we make no warranties regarding the completeness, accuracy, or applicability of content to your specific situation. Financial regulations and practices change, and information current at program delivery may become outdated.

8.3 "As Is" Provision

Services are provided "as is" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose.

8.4 Limitation of Liability

To the maximum extent permitted by law, Fiscal Pathways shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your participation in programs or use of materials. Our total liability shall not exceed the amount you paid for the specific program giving rise to the claim.

9. Termination

9.1 Our Rights

We reserve the right to terminate your participation immediately without refund if you violate these terms, engage in disruptive behavior, or for any conduct we deem inappropriate for the learning environment.

9.2 Effects of Termination

Upon termination, your right to access program materials ceases immediately. Sections of these terms that by their nature should survive termination shall survive, including intellectual property provisions, disclaimers, and limitations of liability.

10. Dispute Resolution

10.1 Informal Resolution

10.2 Governing Law

These terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of law principles.

10.3 Jurisdiction

Any disputes arising from these terms or your use of our services shall be subject to the exclusive jurisdiction of the courts located in Edmonton, Alberta.

11. General Provisions

11.1 Entire Agreement

These Terms and Conditions, together with our Privacy Policy, constitute the entire agreement between you and Fiscal Pathways regarding use of our services.

11.2 Severability

If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

11.3 No Waiver

Our failure to enforce any provision of these terms shall not constitute a waiver of that provision or any other provision.

11.4 Assignment

You may not assign or transfer your rights or obligations under these terms. We may assign our rights and obligations without restriction.

11.5 Modifications

We reserve the right to modify these terms at any time. Material changes will be communicated through our website or direct communication. Continued participation after changes constitutes acceptance of modified terms.
